Deletion of the October 22, 2009 email

After learning of the email communication that Wendy Burgower sent to Judge Bonnie Hellums on October 22, 2009, the day the October 22, 2009 order was signed by Judge Bonnie Hellums, the father issued a subpoena directed to Wendy Burgower and a Rule 12 Judicial Records Request to Judge Bonnie Hellums, who was the records custodian of her Court, in an effort to obtain a copy of the October 22, 2009 email.  

On February 22, 2010, the father filed a Rule 12 Judicial Records Request with the Harris County Administrative Office of the District Courts in which he requested all emails from Wendy Burgower that were received by Judge Bonnie Hellums on October 22, 2009.  Please click on this link to view the Judicial Records Request. 

On February 26, 2010, Deborah Selden, Sr. Staff Attorney of the Harris County Administrative Office of the District Courts, sent a letter to the father informing him that there were no emails found in the Judge’s email inbox from Wendy Burgower on October 22, 2009.  However, Mrs. Selden located 2 other emails that Wendy Burgower had sent to Judge Hellums – One on October 8, 2009 & one on October 15, 2009.  Please click on this link to view the letter from Deborah Selden.  Please click on the following links to view the October 8, 2009 and October 15, 2009 emails that Wendy Burgower sent to Judge Bonnie Hellums. Please note that Wendy Burgower sent these emails directly to Judge Bonnie Hellums outside the presence of all of the attorneys involved on the case.

On February 23, 2010, the father received a letter from Judge Bonnie Hellums in which Judge Hellums informed the father that his Rule 12 Records Request was an improper "ex parte" communication, even though the father sent a copy of the Rule 12 Records Request to all of the persons that were legally entitled to the communication.  Please click on this link to view 2-23-10 letter from Judge Hellums.   

On March 1, 2010, the father issued another Rule 12 Judicial Records Request for the emails from Wendy Burgower that were received by Judge Bonnie Hellums on October 22, 2009.  Please click on this link to view the March 1, 2010 Judicial Records Request.  On March 4, 2010, the father received another letter from Deborah Selden in which she again informed him that Judge Hellums’ email inbox was searched as well as the backup files and there were no emails found from Wendy Burgower to Judge Hellums on October 22, 2009.  Please click on this link to view Mrs. Selden’s March 4, 2010 letter.

Questions:

(1) How is it possible that Judge Bonnie Hellums still had 2 emails that were sent to only her from Wendy Burgower that were sent prior to October 22, 2009 - one email that was sent on October 8, 2009 (2 weeks prior to October 22, 2009) and another email that was sent on October 15, 2009 (one week prior to October 22, 2009), but not have the October 22, 2009 email from Wendy Burgower?

(2) How is it possible that the October 22, 2009 email from Wendy Burgower got deleted from Judge Bonnie Hellums email inbox and the other 2 emails from Wendy Burgower that were sent prior to October 22, 2009 were not deleted from Judge Bonnie Hellums email inbox?  

(3) If, in fact, Judge Hellums did delete the October 22, 2009 "ex parte" email from Wendy Burgower, isn't it true that Judge Hellums had to have considered the October 22, 2009 "ex parte" email from Wendy Burgower if Judge Hellums deleted the email from her email inbox?  Judge Hellums is the records custodian of her emails and the father believes that Judge Hellums had to have read the email if she deleted the email from her email inbox which the father believes proves that the deletion of the October 22, 2009 email from Wendy Burgower was intentional.  The father believes that fact alone proves that Judge Hellums' deletion of the October 22. 2209 email from Wendy Burgower was intentional.  

(4) How is it possible that Judge Bonnie Hellums would consider the father's Rule 12 Judicial Records Request as an improper "ex parte" communication, but not consider the emails (10-8-09, 10-15-09, & 10-22-09) from Wendy Burgower as being improper "ex parte" communications?
